The privacy statement applies to the processing of personal data of our clients, potential clients and other persons visiting our website or having contact with us.

TRC Advocaten respects your privacy and ensures that your personal data is always treated confidentially and in accordance with applicable privacy laws. We strive to safeguard the privacy of our clients, suppliers, staff and third parties as much as possible. In this privacy statement we inform you about how we handle personal data. Processing of personal data by TRC Lawyers

We process the following data:

  • The data you provide to us in connection with the performance of the agreement or its preparation. This includes name, address, zip code, place of residence, country, telephone numbers, year of birth, email address, nationality, bank account numbers and other data (depending on the nature of the agreement);
  • The data we collect, especially if you visit our website. This may include data that you send to us via our website, but also data that we collect automatically via the website, such as browser data, pages that you visit, links that you click, IP address data, etc.

Website

If you contact us through the contact form on the website, by email or by phone, we process the data you provide. This includes the contact information you provide to us (name, e-mail address, phone number) and the reason why you are contacting us (for example, because you have a question). We also process analytical data about (the computer of) visitors to our website, via cookies that are placed when you visit the website. The data we collect about visitors to the website is only used to keep statistics about visits to the website (for example, to see which pages are viewed most). The data is stored anonymously.

Purposes of processing

Your personal data is processed by TRC Lawyers for the following purposes:

  3. the conduct of administration as well as other internal management activities;
  4. collection of debts, including the possible outsourcing of the collection of debts to a third party;

  6. informing you about developments in your case and/or in the area of law in which you are active;
  7. to conduct client satisfaction surveys;
  8. to conduct marketing activities, including sending newsletters and invitations to events organized by TRC Advocaten;
  9. improving the services provided by TRC Advocaten;
  10. complying with legal obligations, such as administration and retention obligations;
  11. handling any disputes with you regarding the performance of the engagement;

Legal grounds for processing your personal data

The legal grounds for the purposes of processing referred to above are as follows:

  • execution of the contract concluded with you, for example, the contract of assignment and/or the employment contract and/or taking pre-contractual measures at your request;
  • the fulfillment of legal obligations, such as the administration obligation and the retention obligation;
  • the consent given by you (unambiguously and specifically);
  • the furtherance of the legitimate interests of TRC Advocaten or of a third party (Art. 6 paragraph 1 sub f AVG);
  • the furtherance of the legitimate interests of TRC Advocaten or of a third party (Art. 6 paragraph 1 sub f AVG).

Explanation of legitimate interests

The aforementioned legitimate interests may be in the following:

  • direct marketing purposes;
  • quality and training purposes;
  • improving the quality of our services;
  • scientific research;

You have the opportunity to object to the processing of your personal data. For this purpose, you have a right of objection. You may withdraw your consent at any time.

Mandatory provision of personal data

When we ask for your personal data, we will make it clear in each situation whether the provision of the data is necessary or mandatory and what the possible consequences are if the data are not provided. The basic principle is that TRC Advocaten will not process more personal data than necessary for the purposes described above.

Transfers abroad

Your personal data may be processed within countries of the European Economic Area (EEA). No processing of your personal data takes place outside the EEA.

Duration of retention

TRC Advocaten will retain your personal data in accordance with applicable laws and regulations and for no longer than is necessary for the fulfillment of the purposes described above, unless such data is necessary for the fulfillment of a legal obligation to retain data with prescribed retention periods.

Security of your personal data

TRC Advocaten will take appropriate technical and organizational measures to secure personal data against loss or against any unlawful form of processing. In that context, various measures have been taken, including encryption of data, encrypted communication and treatment of data as being confidential. Third parties engaged by TRC Advocaten to process your personal data must take the same technical and organizational measures to protect the personal data against loss or against any unlawful form of processing. TRC has recorded agreements to this effect in processing agreements. We would like to list these rights for you here:

1. Right of inspection

You have the right to inspect the data that TRC Advocaten has on you.

2. Right of correction and destruction

You have the right to have your data changed. As a client, you also have the right to have your data destroyed, unless it is reasonably plausible that further retention may be of substantial interest to someone other than you, as well as if a legal requirement precludes destruction.

3. Right of objection

A right of objection means that you can object to certain processing of your personal data because of your specific situation. You have the right in all processing that is not based on your consent, to comply with legal obligations for TRC Lawyers or for the protection of vital interests of yourself or others.

4. Right of Restriction

You also have the right to restrict the processing of your data under certain circumstances. In short, this means that TRC Lawyers "temporarily" freezes the processing of your data. You can invoke this right in four situations:

  • pending review of a correction request;
  • if data should actually be deleted where you do not wish deletion;
  • if TRC Lawyers no longer needs the data, while you need the data to prepare for litigation;
  • pending review of an objection;

5. Dataportability

You have the right to receive (back) data provided by you to TRC Lawyers in a common file format. This right applies only to personal data that we process pursuant to your consent or an agreement entered into with you. Moreover, the right applies only to the data we already process in digital form (i.e. not to "paper" processing). You are free to subsequently transfer the data to another party.

6. Withdrawal of consent

For the data described above, we process your data on the basis of your consent. You have the right at any time to withdraw a consent once given. We will then cease processing as soon as possible. The withdrawal of consent does not have retroactive effect. All processing that has already taken place therefore remains lawful.

Timelines

We will answer your questions/requests in principle within four weeks of submitting the request. Should the answering of your question/request take more time, we will inform you within four weeks.

Change

Sometimes something may change in the personal data we process or the applicable regulations. In that case, we may amend this privacy statement. If the changes are significant, we will post a notice on the website and notify you of the change by email.
