Spousal support

Whether alimony should be paid after a divorce or breakup of registered partnership is regularly the subject of disputes between ex-partners. How much can be paid is determined by the alimony recipient's need and the alimony obligor's ability to pay.

The calculation of need and ability to pay is customized.

The need of an ex-partner is not tabulated, but is derived from the income lived on during marriage. The calculation may take into account all relevant circumstances, including the amount and nature of the parties' income and expenses during the marriage. Own income or an earning capacity reduces the need.

The maintenance obligor's ability to pay should then be determined on the basis of a specially developed calculation method. The income, expenses such as (housing) costs, marital debts, income from assets as well as the costs of children, etc. are important factors that are taken into account.

An alimony calculation complicated, especially if one of the parties is also a business owner or if there is a composite family. Moreover, once determined, alimony does not always remain in effect. Changed circumstances may necessitate a recalculation of alimony.

Our lawyers have extensive experience in making alimony calculations, advising on alimony and litigation. We use the same guidelines as the court and can therefore make a good estimate of your chances in advance.
