You are getting divorced. A difficult period in your life in which you also have to make important arrangements for the future. Agreements about the children, but also agreements about your income, your business and the assets after the divorce.

To obtain a divorce in the Netherlands (or to dissolve a registered partnership in which children were born), a procedure must be followed at the court. Starting divorce proceedings can only be done by a lawyer.

If mutual relations are good, you can choose to be assisted together by one lawyer/divorce mediator (mediation). Even if you both choose to hire your own lawyer, the divorce can be arranged through consultation. The agreements about the consequences of the divorce are then recorded in a divorce covenant.

If it is not possible for you to follow a mediation process together with your partner or to settle the consequences of the divorce from a consultative situation, then substantive litigation will be necessary. In that case, you will choose your own lawyer who will conduct the proceedings on your behalf.
